Fines of up to £20,000

The Home Office recently announced a ‘clamp down’ on those employers who employ illegal workers and highlighted the construction sector as one which they would be particularly targeting.
Following the introduction of new sanctions as part of the Immigration Act 2016, non-compliance can mean fines of up to £20,000 per employee and a potential prison sentence of up to 5 years. 

A wave of police raids following the launch of Operation Magnify, resulted in the arrest of over 250 illegal workers at various construction sites, leading to significant potential fines as well as high profile press coverage and disruption to those sites.

The Considerate Constructor scheme has also introduced a new question into its checklist
'How does the site assess and monitor the legitimacy and competency of the workforce?'
to ensure that contractors seriously consider their recruitment process, including Right to Work checks.

The suggestion from the Home Office is that Tier 1 suppliers, as part of their overall project governance, should include checks to ensure that no illegal workers are present in the supply chain.
