Anyone found to be employing an illegal worker can face fines of up to £20,000 per employee. The Immigration Act 2016 further criminalises the offence of knowingly employing an illegal national with a potential prison sentence and unlimited fines. It's therefore critical to establish the 'statutory excuse' if an illegal employee is found to be amongst your workforce.
